On January 5, 2024 defendant Andre Theron Legree was found guilty as charged for Aggravated Assault with a Deadly Weapon. The Defendant waived his right to a jury trial and was found guilty by Judge Leandra G. Johnson.
On June 28, 2022, following a verbal altercation at a gas station Mr. Legree produced a Glock 19 firearm from his waistband and pointed it at the unarmed victim. Mr. Legree pursued the victim with the firearm as the victim attempted to flee. The Defendant raised a claim of self-defense, which was rejected by the Court.
The Department of Corrections will complete a presentence investigation and prepare a report. Sentencing is currently set for February 19, 2024. The Defendant faces a maximum penalty of five years in State prison. The case was prosecuted by Assistant State Attorney Sean Crisafulli and Assistant State Attorney Michael Pope.
